These Terms of Service ("Terms") govern your access to and use of beachsideicecream.com (the "Site"), operated by Beachside Scoops ("we," "us," or "our"), an ice cream shop located in Cocoa Beach, Florida. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

2. Use of the Site

The Site is provided for general informational purposes, including our menu, hours, location, and links for ordering. You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to attempt to gain unauthorized access to the Site, its hosting infrastructure, or any related systems, and not to interfere with the Site's operation, including by introducing malicious code or conducting automated scraping that burdens the Site.

3. Menu, Pricing, and Hours

Menu items, flavors, prices, and hours of operation displayed on the Site are provided for convenience and are subject to change at any time without notice. While we work to keep the Site accurate, we do not guarantee that all information is current or error-free. In the event of any difference between the Site and the information posted in our shop, the in-shop information controls. Product availability, including specific flavors, is not guaranteed.

The Site and its contents, including text, graphics, logos, images, and design, are owned by or licensed to Beachside Scoops and are protected by applicable copyright, trademark, and other intellectual property laws. Third-party names, logos, and marks that appear on the Site, including Hershey's, Dippin' Dots, and DoorDash, are the property of their respective owners, and their appearance does not imply endorsement. You may view and print pages from the Site for your own personal, non-commercial use. Any other use, including reproduction, modification, distribution, or republication, without our prior written consent is prohibited.

5. Third-Party Links and Services

The Site contains links to third-party websites and services that we do not own or control, including DoorDash for online ordering, an embedded Google map, and our social media pages. We provide these links for convenience only. We are not responsible for the content, policies, or practices of any third-party website or service, and a link does not imply our endorsement.

In particular, all online orders placed through DoorDash are transactions between you and DoorDash and are governed by DoorDash's own terms of service and privacy policy. We are not responsible for the DoorDash platform, its pricing, fees, delivery services, or order fulfillment through that platform.

6. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEACHSIDE SCOOPS AND ITS OWNERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless Beachside Scoops and its owners, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms or your misuse of the Site.

9. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to the personal jurisdiction of those courts.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

11. Changes to These Terms

We may revise these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
